These Terms & Conditions (“Terms”) form a binding agreement between you and PomoGarden (“we”, “us”, “the developer”) governing your use of the App distributed via the Apple App Store. If you are under the age of legal majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download and use the App for your own personal, non-commercial purposes on Apple devices that you own or control. You may not rent, lease, lend, sell, redistribute, or sublicense the App, and you obtain no ownership rights of any kind.
The App and all of its contents are the exclusive property of PomoGarden – Focus Timer and are protected by copyright, trademark, trade secret, and other intellectual property laws of the Republic of Türkiye and by international treaties. This includes, without limitation, the PomoGarden – Focus Timer name, logo, branding, visual and user-interface design, plant artwork and descriptions, animations, text, sounds, the game mechanics and progression systems, and all underlying source code.
You are expressly prohibited from, and agree that you shall not, directly or indirectly:
Any unauthorized use of the App immediately and automatically terminates the licence granted to you and may give rise to both criminal and civil liability. PomoGarden – Focus Timer reserves the right to pursue all remedies available at law and in equity, including without limitation monetary and statutory damages, compensation for losses, and interim (preliminary) and permanent injunctive relief, and to recover the costs and legal fees incurred in enforcing its rights. The App lets you enter text such as a session “intention” and a name for your garden. This content is stored only on your device; we do not receive, access, transmit, or store it. You are solely responsible for any content you create and confirm that it does not violate any applicable law or the rights of any third party.
PomoGarden – Focus Timer is a productivity and motivation tool. We make no guarantee that using the App will improve your productivity, focus, mood, academic or professional performance, or produce any other result. Focus methodologies referenced in the App (including the Pomodoro Technique, Deep Work, and Flowmodoro) are third-party concepts whose effectiveness varies by individual. We do not warrant that the App will be available, uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
PomoGarden – Focus Timer is provided for general productivity and entertainment purposes only. It is not a medical device and does not provide medical, psychological, or health advice, diagnosis, or treatment. Features such as the “focus score” and the optional mood check-ins are intended solely for self-reflection and motivation and are not clinical, diagnostic, or scientific measurements. Do not rely on the App for any health-related decision. If you have any concern about your physical or mental health, please consult a qualified healthcare professional.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POMOGARDEN OR ITS DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP.
Our total aggregate liability for any and all claims relating to the App shall not exceed the total amount you actually paid to us for the App during the twelve (12) months preceding the event giving rise to the claim. Because the App is provided free of charge, our total aggregate liability shall not exceed zero (0), except where a higher minimum is required by applicable mandatory law, in which case liability is limited to the lowest amount permitted. Some jurisdictions do not allow certain limitations of liability; in such cases these limitations apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless PomoGarden – Focus Timer and its developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your misuse of the App, your violation of these Terms, or your violation of any law or the rights of any third party.
We may suspend or terminate your access to and licence to use the App at any time, with or without notice, if you breach these Terms or use the App in a manner that may cause harm. Upon termination, you must cease all use of the App and delete all copies. Provisions that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall survive.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, war, terrorism, civil unrest, epidemic or pandemic, governmental action, labor disputes, or the failure or interruption of the internet, utilities, or any third-party platform or service (including the Apple App Store).
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified, and the remaining provisions shall continue in full force and effect.
These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law principles. You agree that the [Istanbul] Courts and Enforcement Offices of the Republic of Türkiye shall have exclusive jurisdiction to resolve any dispute arising out of or relating to the App or these Terms.
We reserve the right to modify these Terms at any time. We will indicate material changes by updating the date above and, where appropriate, by providing an in-app notice. Your continued use of the App after the effective date of any change constitutes your acceptance of the revised Terms.
