These Terms of Use (“Terms”) are a binding agreement between you and PomoGarden (“we”, “us”, “the Developer”) governing your use of the App, distributed through the Apple App Store, including its widgets, Live Activities and Shortcuts. If you are under the age of legal majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian who accepts these Terms on your behalf.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App for your own personal, non-commercial purposes on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not rent, lease, lend, sell, redistribute or sublicense the App, and you obtain no ownership rights of any kind.
The App and all of its contents are the exclusive property of PomoGarden and are protected by copyright, trademark, trade secret and other intellectual property laws of the Republic of Türkiye and by international treaties. This includes, without limitation, the PomoGarden name, logo, branding, visual and user-interface design, plant artwork and descriptions, animations, text, sounds, the garden mechanics and progression systems, and all underlying source code.
You shall not, directly or indirectly: copy, reproduce, republish, upload, post or publicly display the App or any part of it; distribute, sell, sublicense, rent, lease, lend or otherwise transfer it; create derivative works from it or adapt or modify it; reverse engineer, decompile, disassemble, decrypt or otherwise attempt to derive its source code, algorithms or underlying ideas; or remove, alter, obscure or circumvent any proprietary notice or technical protection.
Any unauthorized use terminates your licence immediately and automatically and may give rise to civil and criminal liability. We reserve all remedies available at law and in equity, including damages, injunctive relief and the recovery of costs and legal fees. All rights reserved.

The App lets you enter text such as a session intention, mode names, goal titles and a garden name. This content stays on your device; we do not receive, access, transmit or store it. You are solely responsible for anything you enter, for how you use the App, and for every decision you make on the basis of information the App shows. You confirm that your use complies with applicable law and does not infringe the rights of any third party.
PomoGarden is a productivity and motivation tool. We make no guarantee that using the App will improve your productivity, focus, mood, habits, grades, exam results, work performance, income or any other outcome. The focus methods referenced in the App (the Pomodoro Technique, Deep Work, Flowmodoro) are third-party concepts whose effectiveness varies by individual. Timers, statistics, insights, scores, streaks, plans and reminders are provided for information and motivation only; they may be inaccurate, delayed, interrupted or lost, and you must not rely on them for anything that matters, including appointments, exams, deadlines, medication or safety.
The App is provided for general productivity and entertainment purposes only. It is not a medical device and gives no medical, psychological or health advice, diagnosis or treatment. The focus score, mood check-ins and all insights are for self-reflection only and are not clinical, diagnostic or scientific measurements.
The Break Coach offers general suggestions such as breathing exercises, desk stretches, posture resets, eye rest and water reminders. These are generic wellness ideas, not instructions tailored to you. You take part in them entirely at your own risk. Stop immediately if you feel dizzy, faint, short of breath or in pain. Do not follow them if you are pregnant, have a cardiovascular, respiratory, musculoskeletal, neurological or other medical condition, or have been advised against such activity, without first consulting a qualified healthcare professional. Never use the App or follow a break suggestion while driving, operating machinery or in any situation that requires your full attention. We accept no responsibility for any injury, illness or harm connected with these suggestions.
If you have any concern about your physical or mental health, consult a qualified healthcare professional. The App is not a substitute for professional advice.
Free and Pro. The App is free to download. The timer, your garden and your daily goal are free. Additional features (“Pro”) are available through an auto-renewable subscription or a one-time Lifetime purchase. Which features belong to Pro is shown in the App and may change between versions; we may add, change, move or remove features at any time.
7-day trial. New installs unlock Pro for 7 days without a purchase and without payment details. The trial ends by itself; nothing is charged and there is nothing to cancel. The trial is intended to be used once per person; it may not restart after reinstalling. We may change, shorten or withdraw the trial for future installs at any time.
Subscriptions (monthly, yearly). Prices are shown in the App Store in your local currency before you buy. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple Account settings (Settings → Apple Account → Subscriptions); deleting the App does not cancel a subscription. Cancellation takes effect at the end of the paid period; there are no refunds or credits for partial periods. Apple may notify you of price changes in accordance with its policies.
Lifetime. The Lifetime purchase is a one-time, non-consumable purchase that unlocks Pro for as long as the App is offered on the App Store and supported on your device. “Lifetime” refers to the life of the App, not of the user, and does not guarantee future features, compatibility with future devices or operating systems, or that the App will be offered indefinitely.
Family Sharing. The yearly subscription and the Lifetime purchase support Apple’s Family Sharing where the App Store makes it available; the monthly subscription does not. Family Sharing is operated by Apple under Apple’s rules.
Restoring, refunds, billing. Purchases can be restored on your other devices with Restore Purchases on the paywall or in Settings. All payments are made to Apple, and refunds are decided and issued by Apple alone under its refund policy and applicable law; we cannot issue refunds, credits or exchanges. For billing questions contact Apple Support. Promotional or temporary prices apply only for their stated period. Taxes may apply.
All App data is stored on your device and, if you enable it, in a backup file in your own iCloud Drive. You are solely responsible for keeping backups and for the security of your device and Apple Account. We have no copy of your data and cannot recover it. We are not liable for any loss, corruption or unavailability of data, for whatever reason, including device loss or failure, operating-system updates, reinstalling or deleting the App, iCloud outages or configuration, or errors in a backup or restore.
The App relies on services operated by Apple, including the App Store, StoreKit, iCloud Drive, notifications, widgets and Shortcuts. These services are governed by Apple’s terms and are outside our control. We are not responsible for their availability, performance, changes or interruptions, nor for any fees your carrier or Apple may charge.
We may update, modify, suspend or discontinue the App or any feature at any time, with or without notice, and we are under no obligation to provide updates, support or maintenance. New versions may require a newer version of iOS. We do not warrant that the App will be available, uninterrupted, timely, secure or error-free, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE APP, CREATES ANY WARRANTY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POMOGARDEN, ITS DEVELOPER, OWNERS OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, HEALTH OR OTHER INTANGIBLE LOSS, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE APP, ITS CONTENT, THE BREAK COACH SUGGESTIONS, ANY TIMER, REMINDER, STATISTIC OR INSIGHT, ANY PURCHASE, OR YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO APPLE FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ZERO (0) IF YOU PAID NOTHING, EXCEPT WHERE A HIGHER MINIMUM IS REQUIRED BY MANDATORY LAW, IN WHICH CASE LIABILITY IS LIMITED TO THE LOWEST AMOUNT PERMITTED. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer-protection rights; in those cases the exclusions and limitations apply to the fullest extent permitted.
You agree to indemnify, defend and hold harmless PomoGarden and its developer from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or connected with your use or misuse of the App, your content, your breach of these Terms, or your violation of any law or of the rights of any third party.
We may suspend or terminate your licence to use the App at any time, with or without notice, if you breach these Terms or use the App in a way that may cause harm. On termination you must stop using the App and delete all copies. Sections 3, 4, 5, 6, 8, 11, 12, 13, 18 and 19 survive termination.
We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, fire, flood, earthquake, war, terrorism, civil unrest, epidemic, governmental action, labor disputes, or the failure or interruption of the internet, utilities or any third-party platform or service, including the Apple App Store and iCloud.
If any provision of these Terms is held invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it.
These Terms, together with the Privacy Policy and the Apple Media Services Terms and Conditions that apply to App Store purchases, are the entire agreement between you and us about the App and replace any earlier agreements. If these Terms conflict with Apple’s Licensed Application End User License Agreement, these Terms prevail to the extent permitted.
These Terms are between you and PomoGarden only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation for the App; if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price to you, and Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, consumer-protection claims and claims that the App infringes a third party’s intellectual property rights, in each case subject to these Terms. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. The Istanbul Courts and Enforcement Offices have exclusive jurisdiction over any dispute arising out of or relating to the App or these Terms. If you are a consumer in a country whose law grants you the right to bring claims before your local courts or under your local mandatory consumer law, that right is not affected.
We may modify these Terms at any time. Material changes are indicated by updating the date at the top of this page and, where appropriate, by a notice in the App. Your continued use of the App after a change means you accept the revised Terms. If you do not agree, stop using the App and cancel any subscription.
